Arcadia seeks to extend the right to collect cell phone usage tax. Officials plan to hold a special election in May or June in 2009 for a ballot measure. If communicated to voters correctly, it should pass, because it would not raise the tax but protect the city's revenues. At stake is about $1 million in yearly revenue. To do that, voters must allow the city to legally redefine what a telecommunications tax is. Recent court rulings have suggested cities cannot tax cell phone use by relying on older telecommunications tax ordinances.

Having faced expansion roadblocks, Rusnak says the City hasn't been able to deliver the acreage and properties as promised. The announcement came as a shock to City Manager Bill Kelly who knew nothing about it.

Arcadia voters will decide, in a special election next week, whether or not to approve ballot Measure A, which seeks to protect the city's right to collect taxes on cell phone usage. Measure A would not raise any taxes. The city already collects taxes on residential cell phone usage and is seeking to legally protect that practice by redefining what constitutes a telecommunications tax.

Caruso and Westfield are still battling over the proposed Caruso lifestyle center. A decade ago the race track's south parking lot had been rezoned for commercial development. Rick Caruso feels his development will help Westfield while Westfield believes a new mall will cannibalize tenants and harm both companies and the city's sales tax revenues.

Church in Arcadia will move to land formerly occupied by the city's mounted police at 630 E. Live Oak Avenue. Church in Arcadia is currently at 21 Morlan Place, the former site of Arc Bowl and Arcadia Bowling, which closed in the late 1970s. This deal was done to try to keep neighbor Rusnak Mercedes Benz, the city's largest sales tax generator, from moving to another city.

The expansion of Rusnak Mercedes-Benz, Arcadia's largest sales tax generator, still faces hurdles. The Church of Arcadia has agreed to move from 21 Morlan Place, but it has encountered delays with the county's plan checks. The City of Arcadia still needs to acquire Rod's Grill at 41 W. Huntington Drive, but proprietor Manny Romero has not accepted any of the city's numerous offers. Tom Valasek, director of marketing at Rusnak Auto Group says the dealership will have to move if the city cannot deliver the land for the expansion plan.

A federal judge overturned several charges in the case of Arcadia man George Torres, 52, accused of running his Numero Uno grocery store chain in Los Angeles like an organized crime ring. He had been convicted of racketeering charges, solicitation of murder and multiple tax and fraud charges when prosecutors came forward with new evidence that appeared to exonerate him on the more serious charges. Torres was released from federal custody after being held without bail for two years.
